Ordinance No. 06-03

 

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEVADA, TEXAS, CANCELING THE ALDERMAN PORTION OF THE GENERAL ELECTION TO BE HELD ON MAY 13, 2006; DECLARING UNOPOSED STATUS FOR EACH CANDIDATE.

WHEREAS: Resolution R06-02 called for a General Election to be held on May13, 2006, for the purpose of electing two (2) Alderman for two (2) year terms each.

WHEREAS: These positions are elected at large.

WHEREAS: Subchapter C. (a)(1), Section 2.052 (a)(1)(2), (b), Section 2.053 (a)(b) of the Texas Election Code, specifies that this subchapter applies to an election of officers of a political subdivision for each candidate whose name is to appear on the ballot is unopposed and that the authority responsible for having the official ballot prepared shall certify in writing that a candidate is unopposed if only one candidate’s name is to placed on the ballot for that office and no candidate’s name is to be placed on the list of write in candidates for that office. On receipt of the certification, the governing body of the political subdivision may declare each unopposed candidate elected to the office. If a declaration is made, the election is not held.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEVADA, TEXAS:

Section 1: By Certification from the City Secretary the City Council of the City of Nevada, Texas declares each unopposed candidate elected to the office of Alderman.

Section 2: No Election will be held for the offices of Alderman on May 13, 2006.

Section 3: A certificate shall be issued to each candidate after the date on which the canceled election would have been held.
