WHERAS, the City of Nevada approved the City Attorney pursuant to State law, which requires the City Council to appoint, by ordinance, a City Attorney.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEVADA, TEXAS:

Section 1. That all matters stated in the preamble are found to be true and correct and are incorporated herein for all purposes.

Section 2. That the City Council appoints William A. Messer as the City Attorney for the City of Nevada effective 12:00:02 a.m. on the 12^th day of April, 2006.

Section 3. The term for the City Attorney shall be a two year term, but the initial appointee, William A. Messer, shall serve a term corresponding to the term of Mayor.

Section 4. The City Council shall establish the compensation for the City Attorney.

Section 5. That the public importance of this measure creates an imperative public necessity, and this Ordinance shall take effect and be in full force and effect immediately upon its passage. This Ordinance shall take effect and be in force and effect from and after its final passage.

Section 6. It is hereby declared to be the intention of the City Council of the City of Nevada, Texas that sections, paragraphs, clauses and phrases of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance since the same would have been enacted by the City Council of the City of Nevada without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.

Section 7. That this Ordinance shall be effective from and after its passing.
