43.028, petitions for annexation of the land described herein were submitted to the City, and duly considered and accepted by the City Council of Nevada; and
WHEREAS, the City of Nevada believes that annexation of the property hereinafter descried is in the best interests of the citizens of Nevada, and the owners and residents of the area seeking annexation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEVADA, TEXAS:
SECTION 1. Annexation
That the following described territory, to wit:
Tract One 74.16 acres of land situated in the Willis Rogers Survey, Abstract No. 748, Collin County, Texas,
Tract Two 14.09 acres of land situated in the S. M. Rainer Survey, Abstract No. 740, the Willis Rogers Survey, Abstract No. 748 and the James Osgood Survey, Abstract No. 673 Collin County, Texas
Tract Three 60.00 acres of land situated in the S. M. Rainer Survey, Abstract No. 740, Collin County, Texas, owned by Janey Pharr Way, currently Janey Mobley which is further described in the metes and bounds described in the attached Exhibit "A" incorporated herein for all purposes.
Be and the same is hereby annexed into the City of Nevada, Collin County, Texas, and that the boundary limits of the City of Nevada, Texas, be and the same hereby extended to include the above-described territory within the city limits of the City of Nevada, Texas, and that same shall hereafter be included with the territorial limits of said City and said land and the inhabitants thereof shall be hereafter entitled to all rights and privileges of other citizens of the City of Nevada, Texas and shall be bound by the acts and ordinances of said City.
SECTION 2. Severability
It is hereby declared by the City Council of the City of Nevada that if any of the sections, paragraphs, clauses, phrases or provisions of this ordinance shall be declared unconstitutional or otherwise illegal by the valid judgment or decree of a court of competent jurisdiction, such event shall not affect any remaining sections, paragraphs, sentences, clauses or phrases of this ordinance.
SECTION 3. Effective Date
This ordinance shall be in full force and effect from and after February 6, 2007.
SECTION 4. Open Meeting
It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
SECTION 5. Filing Instructions
The City Secretary is directed to file a certified copy of this Ordinance with the County Clerk of Collin County, Texas, and with the Collin County Central Appraisal District.
