WHEREAS, the City of Nevada is a Type A General Law Municipality; and

WHEREAS, by Proclamation issued December 30, 2005, the County Judge of Collin County declared a state of disaster for Collin County resulting from the potential threat of wildfires due to drought and adverse weather conditions; and

WHEREAS, the County Commissioners declared a state of disaster for Collin County resulting from the potential threat of wildfires due to drought and adverse weather conditions on January 5, 2006; and

WHEREAS, said state of disaster requires that certain emergency measures be taken pursuant to the Texas Disaster Act of 1975 relating to Emergency Management; and

WHEREAS, Chapter 418 of the Texas Government Code provides the authority for the Mayor, as the presiding officer of the City, to declare a local state of disaster; and

WHEREAS, the Mayor, exercising the authority granted under Chapter 418 of the Texas Government Code, proclaimed a local state of disaster; and

WHEREAS, the City has in place an Emergency Management Plan to address such imminent threat of severe damage, injury or loss of life or property; and

WHEREAS, the City Council of the City of Nevada has determined that extraordinary measures must be taken to alleviate the suffering of people and to protect or rehabilitate property.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NEVADA, TEXAS, THAT:

1. That a local state of disaster is hereby declared for the City of Nevada pursuant to Section 418.108(a) of the Texas Government Code.
2. Pursuant to Section 418.108(b) of the Texas Government Code, this declaration of a local state of disaster shall continue for the period of time that the County continues in effect Order No.HR-2-05.
3. Pursuant to Section 418.108(c) of the Texas Government Code, this Declaration of a local state of disaster shall be given prompt and general publicity and shall be filed promptly with the City Secretary of the City of Nevada.
4. Pursuant to Section 418.108(d) of the Texas Government Code, this Declaration of a local state of disaster activates the City of Nevada Emergency Management Plan.
5. Due to the emergency nature inherent in a local state of disaster, this Resolution shall take immediate effect for so long as the County Order No. HR-2-05 remains in full force and effect.
