MINUTES
- Call to Order Mayor Christy Schell, called the meeting to order. Council members present, Mike Shea, Philip Barth, Johnny Stevenson, Joe Poovey and Wayne Drummonds
- Citizens to Speak Before the Council

- New Business
- Discuss/Take Action – Non-conforming structure 659 S Fm 1138. Robert and Tim Alexander owners. Mayor Schell – The city received a complaint that there are two maybe three structures on this one lot that are being occupied. Mr. Alexander – There are two structures, two septics and two water meters. No one is occupying the storage building. Mayor Schell – I recall a conversation with the owners that the mobile home would be removed once the new home was built. Mr. Alexander – That is correct, and it was removed, at the time the new house was built there were two mobile homes and the storage building on the property. We were told that no one could live in the storage building and to make sure of that steps were taking to disable the septic. Mayor Schell – I recall the conversation with your father that the mobile home was leaving once the house was finished. You were in the military at the time and he said when you returned the mobile home would be removed. Mr. Drummonds – Why are we even questioning that there are two residencies on three and a half acres with two septics systems? Mayor Schell – The two structures are not on three acres they are located on the front two hundred and fifty feet of the property. The reason this is coming up, is we had a deal and its never been followed through. Mr. Alexander – We believe there was a misunderstanding of the totality of the deal. Some one from the city did have a conversation with my mother, and at some point during that conversation my mother expressed that at some point my son would probably be moving on. Absolutely, but circumstances change I have a life here with my wife and son, my term with the military was not up until September of last year, my wife teaches at the school and is working her way through college. I am not in a position nor was I ever told there was a definitive date to be out. I believe there was some confusion on what was going to be removed and when. Mr. Caperton believes that the mobile home was moved in after the new home was built and that we are sharing one septic, which is just simply not true. Mr. Drummonds – Do we have a written agreement from 2002 between the city and Mr. Alexander? Mayor Schell – I don’t recall, we would have to search our records. Council agrees they would like clarification from Wes (city officer) and research any documents the city may have, this can be done when council convenes for executive session and we will give you a decision when council reconvenes the council meeting. Mr. Drummonds motioned to allow the non-conforming structure to remain Tim Alexander’s residence, Mr. Stevenson seconded the motion, all in favor, aye, motion carried.
- Discuss/Take Action – Order General Election May 12, 2007. Mr. Shea motioned to approve, Mr. Drummonds second the motion, all in favor, aye, motion carried.
- Discuss/Take Action - Paul Renfro subdivision. Mr. Renfro was not present. No discussion, no action.
D. Old Business
- Discuss/Take Action - Coleman Subdivision Streetlights. Mr. Shea made a motion for the recommended 16 streetlights, Mr. Stevenson seconded the motion, all in favor, aye, Mr. Drummonds apposed, motion carried 4 to 1.
- Discuss/Take Action – Mounger Property 202 S FM 1138. Mayor Schell – I just wanted to say this is costing us a lot of money, we now have a court order from Collin County that allows us to enter onto his property and clean it up, we have to do this within 45 days of this judgment. We have money in the budget to clean up properties and we will put a lien on the property. No action is required the money is in the budget. I just wanted to foreworn the council of further expense.
- Discuss/Take Action – Public Safety Bldg. Mayor Schell – The Fire Department is doing a show and tell tonight, they have equipment at the back of the hall to look at and trucks outside. Fire Chief Pulvino – We just wanted to show the council some of the new equipment we have acquired, we brought some trucks to give the council an idea of size. We thought this would allow the council to understand some of the requests that we suggested for the new building. Mr. Shea motion to approve the preliminary plan and move forward with the project contingent on the city hall, Mr. Stevenson seconded the motion, all in favor, aye, motion carried.
- Discuss/Take Action – Roads – Mayor Schell – We received the estimate of cost for the road repairs discussed in the last meeting. We don’t have enough money, my thought is, we have the $6,200 for repairs on Kerens Street, the money is there for West under ditch and culvert repairs, we’re $5,000 short on Eve Street, East and Cole would be out until next year. Council agrees to repairs on Kerens, chipseal Eve and repair ditch and culvert on West.
