MINUTES
- Call to Order Mayor Christy Schell, called the meeting to order. Council members present, Mike Shea, Philip Barth, Johnny Stevenson, Joe Poovey and Wayne Drummonds
- Citizens to Speak Before the Council
Janet Hargett / Well House – Did Barnes send a Check for $250? If yes can we go ahead and schedule the dumpsters for demolition? Mayor Schell – Yes. Ms Hargett – I want to talk about my neighbors 202 S FM 1138. What is the City doing to make them clean up? Mayor Schell – (in short) The city has legal action against him now.
- New Business
- Public Hearing
Discussion and comments from the public on a requested variance to Ordinance 03-08. This variance, if approved, would reduce the required square footage of a new construction home to be built on the property located at 113 Warren St. No Comments from the public. Public hearing closed 7:15
- Discuss /Take Action on Requested Variance to Ordinance 03-08. Mr. Shea motioned to approve the variance, Mr. Stevenson second the motion, all in favor, aye, motion carried.
- Discuss/ Take Action on 101 Kerens St Non Conforming Structure.
Jeremy Bullock to represent Benny and Jean Riley. Mayor Schell – Our ordinance says that if a mobile home in a non-mobile area is vacant for more than 90 days, it needs to be removed. TXU pulled the meter at this house sometime before August 21st. On August 21st is the first time we knew the meter was gone. TXU said that their last usage was on June 16th, Mr. Caperton noted that date to determine the 90 days. We received a request for a release to have the meter put back, on October 4th. I spoke to Mrs. Riley and she said due to health issues her or her husband could not be here today. You should have a copy of a letter from the Riley’s asking Mr. Bullock to represent them today and a copy of Mr. Caperton’s notes, who could also not be here today. The gentleman that wants to move into the house is their son, and he also has health issues and has been hospitalized. The Riley’s are requesting that the Council allow the son to reoccupy the home. Mr. Bullock brought no proof that the house was occupied during the period the Code Enforcement Officer determined it to be vacant. By Mr. Bullock’s own admission the house had actually been vacant since the first of the year when the sister moved out, that the son was set to move into the house in March, but never did due to being hospitalized. Council concluded the home was never occupied during the 90-day period. No motion.
- Discuss/ Take Action on Developers Agreement from Carroll Consulting. Changes to be made to item 5 and 6. Item 5 will be deleted completely and item 6 will change to 4 1/2 %, half due at the beginning and half due at the end of construction. Also, we need to clarify the screening on the commercial piece. Bart Carroll – If the Mayor will note the changes on a copy tonight, I will take it back with me, make the changes and send it back here to the City Hall for signatures. Mr. Drummonds motioned to approve with the changes noted, Mr. Shea second the motion, all in favor, aye, motion carried.
- Discuss/ Take Action on Developers Agreement from Coleman Homes. Item 4 the developer reduced the amount of sidewalks that was originally proposed on the conceptual plan. No motion. Will discuss further in a workshop.
- Discuss Requested Variance from Robert and Lois Taylor, Lot 8, 225 Maple Circle. This Variance would allow them to construct a secondary building before a primary building. Mr. Stevenson – Will you at anytime occupy this metal building? Mr. Taylor – No, it’s for storage purposes only. Mr. Shea – Explain to me why you can’t build a storage building before you build your house. Per Wes Caperton, City Building Inspector according to the International Code the definition of Accessory Building is exactly that, it is an accessory to the main structure. Set Public Hearing Date – Public hearing will be set to meet time requirements for public notice.
- Discuss Fire Department Finance Ron Greiner with Government Capital to speak. After 20 minutes of discussion council concluded to set up a workshop for further discussion.
